Know the Law: Credit Card Theft in Pennsylvania (Access Device Fraud)
Pennsylvania treats credit card theft as a form of “access device fraud.” The statute is 18 Pa. C.S. § 4106. It covers credit cards, debit cards, account numbers, electronic access codes, and any instrument that permits payment or withdrawal of funds. To secure a conviction, the prosecution must prove:
- The defendant possessed, used, sold, transferred, or trafficked an “access device”;
- The defendant acted without authorization; and
- The defendant had the intent to obtain property or services, or an intent to defraud the card issuer, the account holder, or the merchant.
Penalties for credit card theft vary based on the value of the property obtained or attempted. It could be charged as a misdemeanor offense in some cases. However, the crime of Access device fraud (including credit card theft) becomes a felony of the third degree if the value reaches $1,000 or more. Notably, the crime becomes a felony of the second degree if the offense involves trafficking in ten or more access devices (credit cards). A conviction for felony credit card fraud can carry serious jail time in Pennsylvania.
Note: In Pennsylvania, the criminal credit card theft statute covers both completed fraudulent transactions and attempted fraudulent transactions. Even possession of another person’s card without consent may satisfy the statute if prosecutors can show intent to use it unlawfully.
